One of the most important classical commentaries on the Muwaṭṭaʾ of Imām Mālik, authored by the eminent Andalusian Mālikī jurist and scholar Qāḍī Abū al-Walīd Sulaymān ibn Khalaf al-Bājī (d. 474 AH). Al-Muntaqā occupies a particularly important position at the intersection of Ḥadīth commentary and Mālikī Fiqh, explaining the Prophetic traditions and reports of the Muwaṭṭaʾ while giving sustained attention to the legal questions derived from them.
The work is actually a condensation of al-Bājī’s much larger commentary on the Muwaṭṭaʾ, entitled al-Istīfāʾ. In his introduction, al-Bājī explains that the size and abundance of discussions in al-Istīfāʾ made it difficult for many students to study. He therefore produced al-Muntaqā, restricting himself principally to the meanings of the aḥādīth, the Fiqh contained within them, the fundamental legal questions connected to the text, and indications of how rulings are derived from the narrations. Despite being an “abridgement,” the resulting work remains a large and sophisticated commentary.
A major strength of al-Muntaqā is its detailed treatment of Fiqh al-Ḥadīth. Al-Bājī explains the wording and meanings of the narrations and then carefully develops the legal issues arising from them, frequently arranging his discussions under individual masāʾil. He records the positions transmitted from Imām Mālik and leading authorities of the Mālikī school—such as Ibn al-Qāsim, Ashhab and others—while examining their reasoning and evidences. This makes the work an important source for understanding not only the Muwaṭṭaʾ itself but also the development and internal reasoning of classical Mālikī jurisprudence.
The commentary is by no means limited to reporting the Mālikī position. Al-Bājī regularly records juristic disagreement, compares alternative interpretations and adduces evidence for the different positions before defending or preferring a conclusion. His treatment consequently reflects his considerable expertise in uṣūl al-fiqh and legal argumentation. Linguistic questions, the implications of particular expressions, variant understandings of a narration and the relationship between Ḥadīth evidence and legal principles also feature prominently throughout the work.
For students of the Mālikī school, al-Muntaqā is therefore especially valuable as a substantial source for comparative Fiqh, the evidences of Mālikī rulings and the juristic interpretation of the Muwaṭṭaʾ. For students of Ḥadīth more generally, it demonstrates how one of the leading jurists of fifth-century al-Andalus read the traditions of Imām Mālik through the combined disciplines of narration, language, legal theory and Fiqh.
