It is a sad reality that parents sometimes pass away leaving behind young children.
These children are the placed under the care of a guardian, known as الوصي in fiqh.
It is very challenging for these guardians to know what their authority extends to and how they are expected to carry out each transaction on behalf of these children.
These masail are also difficult for muftis to find, as they are spread across the hundreds of books of Hanafi fiqh. This amazing work, gathers these masail in one book.
The author starts by first advising one never to willingly become a guardian, due to the heavy responsibility it carries.
He then goes into detail on who should be appointed and the manner of appointing a guardian.
The main body of the book is around 30 chapters, each covering a specific chapter in fiqh like ijarah, wakalah, hibah etc and discusses all the masail of this sort connected to guardians. This is a treasure-trove for a mufti/alim searching for a mas’alah, as the author gives the source of every mas’alah from the classical fiqh works.
The editors then made takhrij of these nuqul and give you the exact page number for these masail.
The book then finishes off with chapters on how to resign or withdraw from being a guardian, what happens when there are multiple guardians etc.
This book is a must for a library of any Mufti as well as any alim frequently involved in cases affecting guardians and children.
This is a beautiful, high-quality edition, edited using seven manuscripts and printed seperately for the first time.
