Our Din is unique in that we have detailed injunctions covering every aspect of our lives. The enemies of Islam have always attempted to eradicate this aspect from the lives of Muslims. Their attempts at introducing French Law under the Ottoman Empire were rebuffed by the group of ulama and experts at law who introduced the Majallah.
After they collapse the Ottoman Empire, the kuffar attempted to introduce their secular law into the various Muslim States.
In an attempt to make it seem acceptable, instead of completely removing Islamic Laws, they substitute ijma’i laws, with shadh views, that are a stepping stone to completely rejecting the ahkam of Shari’ah.

It is no surprise that they always had the modernists pushing their agenda, however it is tragic that sometimes brilliant ulama unwittingly get used by these enemies of our Din.

In Egypt, the famous muhaqqiq and muhaddith, Sh Ahmad Shakir, authored a book “Nizam at-Talaq” wherein he robustly campaigned for the adoption of Ibn Taymiyah’s shadh view regarding three types of Talaq:
1- 3 talaqs together equal 1
2- Talaq in hayd doesn’t take place
3- Talaq mu’allaq doesn’t take place.
This was part of the modernist’s campaign to revamp the ahkam of nikah and talaq in Egypt at the time and was subsequently adopted as part of the legislation, inspite of opposition to it from the ulama of the time.

Allamah Kawthari authored this amazing work, in refutation of Sh Ahmad Shakir’s book. While it has been printed a few times, the book lacked a good edition.

Dr Hamza Bakri, not only expertly edited the book and filled the footnotes with fawaid, but also prepared a detailed muqaddimah, giving us exactly what we need to properly understand the book.
He explained the history behind the book, pointed out the major mukhtalaf fih masail, showed how they are really proven through ijma and followed this with a detail comparison between the book of Kawthari and that of Ahmad Shakir.

This expertly-prepared muqaddimah allows on to properly benefit from Allamah Kawthari’s book and is really beneficial.
