While our madaris generally produce graduates firmly entrenched in following a madhab, we often don’t have enough exposure to the arguments of those favouring other fiqhi manahij, which leads to some of our grads being attracted to them, without realising the major issues with them. This is especially so for the Taysiri approach that many of the young ulama in West have fallen for.
Ml Muhammad Abbasoomar has realised this and just had the following book printed:
“This book highlights three contemporary juristic methodologies with in-depth analysis:
1. The traditional school (madhhabi) approach, whose adherents restrict themselves to the juristic interpretations of one of the four renowned schools of Islamic law: Hanafi, Maliki, Shafi’i, and Hanbali.
2. The Salafi approach, whose adherents rely on direct derivation of rulings from the Quran and Sunnah, and do not see the legitimacy of adhering to a specific school of jurisprudence except in limited cases.
3. The convenient (taysiri) approach, whose adherents share with the Salafi approach in not being bound to any specific school of jurisprudence, but tend to favor the easiest of juristic opinions.
The book explains the points of agreement and disagreement among them, and clarifies the extent of their adherence to a disciplined framework for juristic reasoning and derivation (ijtihad and istinbat).Whilst also highlighting the discrepancies in the latter two methodologies.
